Receiver/Trustee
In a Receivership, responsibility and authority flows from the Order Appointing Receiver issued by a Court of Competent Jurisdiction. Effectively, we are an agent of the Court, not the conflicted parties. As Trustees our authority and fiduciary duties are directed by the Trust Documents, a Court, the Law, or other legal directives of parties with legal Standing. Although usually associated with commercial enterprises and real estate, Receivers and Trustees may be employed in a variety of non-commercial real estate, civil, and domestic matters. See more information at Receiverships Southwest and at US ASSET GUARDIANS LLC.(Commercial Association of Realtors of New Mexico).
